These Terms Of Service (also “Terms of Use” and/or “Terms and Conditions”) for Car Service for Information Technologies LTD (doing business as Turqat) (“Turqat,” “we,” “us,” or “our”), describe The Terms and Conditions of Service when you use our services (“Services”), such as when you:

Visit our website at https://www.turqat.co, or any website of ours that links to this privacy notice
Download and use our mobile application (Turqat), or any other application of ours that links to these Terms and Conditions
Engage with us in other related ways, including any sales, marketing, or events

BY ACCESSING, VIEWING, CREATING AN ACCOUNT OR MAKING A PURCHASE THROUGH TURQAT APPLICATION AND/OR WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE (“TERMS OF USE”). TURQAT RESERVES THE RIGHT TO MODIFY THESE TERMS OF USE AT ANY TIME AND WITHOUT PRIOR NOTICE. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING THESE TERMS OF USE PRIOR TO ACCESSING THE APPLICATION, WEBSITE, AND/OR ANY OTHER SERVICES. YOUR CONTINUED USE OF THE SERVICES CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF USE, UPDATES, AND MODIFICATIONS THEREOF. IF YOU DO NOT AGREE WITH THESE TERMS OF USE, UPDATES, AND/OR MODIFICATIONS THEREOF, YOU MUST IMMEDIATELY CEASE USE OF THE SERVICES.

Turqat’s Services

Turqat is providing you access to service providers for Emergency and/or Routine roadside assistance for you and/or your vehicle. Turqat’s mobile application, website, and related services (“Services”) enable users to locate and connect with Service Providers, manage orders, manage memberships and subscriptions, and pay for Services. Turqat’s services are limited within the geographical coverage (Service Area) of Turqat and its service providers, which is updated from time to time, and is not obligated to provide any services outside of its Service Area.

User Behavior & Conduct

To use Turqat’s Services, you must register for and maintain an active personal user account and must be at least 18 years of age. Account registration requires you to submit to Turqat certain personal information, including, but not limited to: Name, Gender, Address, Mobile Phone Number, Date of Birth, as well as valid payment method supported by Turqat when purchasing services online. You agree to maintain accurate, complete, and up-to-date information in your user account. Your failure to maintain accurate, complete, and up-to-date account information may result in your inability to access or use Turqat’s Services. You are responsible for all activity that occurs under your account, and you agree to maintain the security and secrecy of your account username and password at all times.

Only you are authorized to use your account and may not authorize another person(s) or any entity(ies) to use your account. You cannot assign or otherwise transfer your account to any other person(s) or entity(ies). You will comply with all applicable laws when accessing or using Turqat’s Services.

Turqat Network Access

Access to the Services are done through your mobile phone or device. You are responsible for obtaining the data network access necessary to use the Services. Your mobile network data and messaging rates and fees may apply if you access or use the Services from your device. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and any updates thereto. Turqat does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.

Turqat’s Subscriptions & Payments

Turqat offers certain enhanced features of the Services which you can purchase as a yearly subscription (“Subscription” and/or “Membership”). A description of features associated with Subscriptions is available via the Services. When you purchase a Subscription or a Service (each, a “Transaction” and/or “Order”), we may ask you to supply additional information relevant to your Transaction, such as your credit card number, the expiration date of your credit card and your address(es) for billing and delivery (such information, “Payment Information”). You represent and warrant that you have the legal right to use all payment method(s) represented by any such Payment Information. The amounts due and payable by you for a Transaction through the Services will be presented to you before you place your order (“Estimated Total”), however, the amounts might be adjusted based on the final order status (i.e. if any extra services and/or parts are ordered), which will then be presented to you for final confirmation.

If you choose to initiate a Transaction via the Services, you authorize us to provide your Payment Information to third party service providers so that we can complete your Transaction and agree (a) to pay the applicable fees and any taxes; (b) that Turqat may charge your credit card or third party payment processing account, including, but not limited to, your account with the app store or distribution platform (like the Apple App Store, Google Play) where the App is made available (each, an “App Provider”), for verification, pre-authorization and payment purposes; and (c) to bear any additional charges that your App Provider, bank or other financial service provider may levy on you as well as any taxes or fees that may apply to your order. All payments made are non-refundable and non-transferable except as expressly provided in these Terms.

If you have any concerns or objections regarding charges, you agree to raise them with us first and you agree not to cancel or reject any credit card or third party payment processing charges unless you have made a reasonable attempt at resolving the matter directly with Turqat. Turqat reserves the right to not process or to cancel your order in certain circumstances, for example, if your credit card is declined, if we suspect the request or order is fraudulent, or in other circumstances Turqat deems appropriate in its sole discretion. Turqat also reserves the right, in its sole discretion, to take steps to verify your identity in connection with your order. You may need to provide additional information to verify your identity before completing your Transaction (such information is included within the definition of Payment Information).

Subscriptions Automatically Renew Until You Cancel & How to Cancel Your Subscription: All amounts are payable and charged for monthly, quarterly or yearly subscriptions, at the beginning of the subscription and, because each such subscription renews automatically for an additional period equal in length to the expiring subscription term until you cancel it, at the time of each renewal until you cancel, using the Payment Information you have provided. You must cancel your monthly or yearly Subscription before it renews to avoid the billing of the fees for the next Subscription period. If you purchase your Subscription via our website, you can cancel the renewal of your subscription at any time from the same website or by contacting us by email at contact@turqat.co

If you purchase your Subscription via an App Provider, you can cancel the renewal of your subscription at any time with the App Provider. You will not receive a refund for the fees you already paid for your current subscription period and you will continue to receive the Services ordered until the end of your current Subscription period.

Changes to Price Terms for Subscriptions: Turqat reserves the right to change its pricing terms for Transactions and/or Subscriptions at any time and Turqat will notify you in advance of such changes becoming effective. Changes to the pricing terms will not apply retroactively and will only apply for New Transaction and/or Subscription Renewals after such changed pricing terms have been communicated to you. If you do not agree with the changes to Turqat’s pricing terms then you may choose not to renew your Subscription in accordance with the section “Subscriptions Automatically Renew Until You Cancel & How to Cancel Your Subscription.”

How to Subscribe for an Annual Membership:

Fill-in the subscription form, and agree on Terms & Conditions.
Upload a personal photo ID and Registration (License) of the vehicle you wish to subscribe.
Pay the subscription fees.

Future Functionality: You agree that your purchases are not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by Turqat regarding future functionality or features.

Restrictions and Constraints of Annual Membership (Regular):

The membership is activated 24 hours after you pay the subscription fees, and expires one year from payment date.
- For example, if you pay the fees on 01-01-2023, your membership will start on 02-01-2023, and will last until the end of 01-01-2024
Annual Membership is related to the vehicle registered for subscription, and cannot be used or transferred to any other vehicle without prior written approval from Turqat
Tire Repair / Replacement: up to 3 times per year are included for free, and does not include the price of the tire and/or other parts in the case of tire replacement.
Fuel Delivery: up to 3 times per year are included for free, and does not include the price of fuel.
Battery Jump Start / Replacement: up to 3 times per year are included for free, and does not include the price of Battery and/or other parts in the case of Battery Replacement.
Towing : up to 1 time per year for a verified mechanical failure, and up to a cost of 250 ILS.
You can order any of the services with regular price when the membership expires or after usage of all the allowed number of services per each category.
Turqat reserves the right to deny Subscription and/or Membership for any vehicle at its own discretion.
It is the responsibility of the User to ensure the Subscription and/or Membership is renewed and valid to access Membership Benefits .

Restrictions and Constraints of Annual Membership (EV):

The membership is activated 24 hours after you pay the subscription fees, and expires one year from payment date.
- For example, if you pay the fees on 01-01-2023, your membership will start on 02-01-2023, and will last until the end of 01-01-2024
Annual Membership is related to the vehicle registered for subscription, and cannot be used or transferred to any other vehicle without prior written approval from Turqat
Tire Repair / Replacement: up to 3 times per year are included for free, and does not include the price of the tire and/or other parts in the case of tire replacement.
Towing: up to 2 times per year for a total loss of vehicle’s battery charge (towing to the nearest PalEV chagrining station or the home of the vehicle’s owner – whichever is closer to the vehicle’s location – , and up to a cost of 250 ILS).
- The membership includes PalEV credit of up to 30 Minutes of charging for each towing service, to be used only when the vehicle is towed to a PalEV station
Turqat is not responsible for any damage(s) to the vehicle and/or battery that might occur before, during, or after the loss of charge and towing to the location specified as above.
You can order any of the services with regular price when the membership expires or after usage of all the allowed number of services per each category.
Turqat reserves the right to deny Subscription and/or Membership for any vehicle at its own discretion.
It is the responsibility of the User to ensure the Subscription and/or Membership is renewed and valid to access Membership Benefits.

Cancellations and Refunds

By using our services and/or transactions, you agree that our Transactions are non-refundable and non-transferable. Once orders are placed, you have up to two minutes to cancel your order without being charged, after which you will be charged a minimum of 1/3 of the price of the service.

Annual Memberships and Subscriptions are non-refundable and cannot be transferred to another vehicle without prior written approval from Turqat.

Privacy

Turqat collects and uses personal information in connection with Services as described in its Privacy Policy. You agree you have reviewed and specifically consented to Turqat’s Privacy Policy and any changes thereof as detailed within Turqat’s app or on Turqat’s website.

Communication From Turqat

You agree Turqat may contact you by telephone, email, and/or text messages (including by an automated system) at any of the email addresses and phone numbers provided by you. Although the main purpose of these communications is for customer service reasons, it may be for marketing purposes. Turqat users may opt-out of communications by emailing privacy@turqat.co

Indemnification

You agree to indemnify and hold Turqat and its affiliates and their officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees), arising out of or in connection with: (i) your use of the Services or services or goods obtained through your use of the Services; (ii) your breach or violation of any of these Terms; (iii) Turqat’s use of your User Content; or (iv) your violation of the rights of any third party.

Disclaimers

You acknowledge and agree that by clicking on any button within Turqat’s Services labeled as an action to purchase, confirm, order, agree or similar label with legal consequences constitutes your acceptance of these Terms by electronic signature and are entering into a legally binding contract.
You agree that your use to Turqat’s services (and any other services offered via Turqat’s site or app) is solely at your own risk.
In addition, all users specifically understand and agree that any third party directing users to Turqat’s site or app by referral, link or any other means is not liable to you for any reason whatsoever, including but not limited to damages or loss associated with the use of the services.
Turqat disclaims all warranties, whether statutory, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, related to any Transaction, Order, and/or Subscription offered via Turqat’s Services.
Turqat reserves the right to cancel any Memberships and/or Subscriptions at any time without refund, indemnification, or penalty.
Turqat reserves the right to cancel, without refund, any order and/or transaction for Towing, if the vehicle is not on a paved road, and/or is not on all four wheels.
Turqat reserves the right to verify vehicle Failure faults prior to any Towing service.
Turqat is not responsible for any delays or failure in providing services caused by force majeure or any external factors.
In no event shall Turqat be liable for any injury, loss, claim, damage or any special, exemplary, punitive, incidental or consequential damages of any kind. Moreover, Turqat is not responsible, and will not be held liable, for any damages, accidents, theft, and/or others, if the responsible person(s) are a third party or due to force majeure.

Violation of Terms of Service

Violation of these Terms is grounds to account termination, refuse your access to Turqat’s Services, and other punishment deemed appropriate by Turqat. Violation of these Terms is determined solely at the discretion of Turqat.

Governing Law and Venue

This agreement shall be interpreted, construed and governed by the laws of the State of Palestine / Ramallah. If for any reason a claim proceeds in court rather than in arbitration, the dispute shall be exclusively brought in the State of Palestine / Ramallah.

Terms of Service Changes

Turqat reserves the right to make changes to these Terms from time to time without prior notice. Your continued use of Turqat’s Services constitutes your consent to any changes. However, you acknowledge and agree you are solely responsible to review these Terms before accessing Turqat’s Services.

Due to the current unfortunate situation in Palestine, the Prizes Campaign has been put on hold until a later date.

Prizes Campaign Terms and Conditions:

Campaign starts on 23/09/2023 and ends on 28/12/2023
To enter the draw for prizes, you need to create an account on Turqat app, in addition to entering your vehicle’s information.
The campaign is valid only for real accounts, and not for any fake accounts and/or pseudonym accounts.
The campaign applies to accounts created before and during the campaign period only.
The campaign is valid in the West Bank only.
The prize is linked to the registered account and cannot be used or transferred to any other account/vehicle without the prior written consent of Turqat.
As a prerequisite for the disbursement of the prize, the winner(s) consent to publish/share their name/information by Turqat through various advertising means.
The free subscription includes the following services only, and all other regular subscription constrains apply:
- Tire Repair / Replacement: up to 1 time per year is included for free, and does not include the price of the tire and/or other parts in the case of tire replacement.
- Fuel Delivery: up to 1 time per year is included for free, and does not include the price of fuel.
- Battery Jump Start / Replacement: up to 1 time per year is included for free, and does not include the price of Battery and/or other parts in the case of Battery Replacement.
The company has the right to withdraw the free subscription and cancel it after 6 months in case of non-use and/or according to the company’s policy for inactive accounts and/or those deleted/canceled by the user.
The prizes draw will be conducted as follows:
- The draw is made first on free subscriptions, and is applicable to all accounts on the Turqat App that are not subscribed for Annual Membership.
  - The draw will be for 25 subscriptions every month from October to December (with a total of 75 free subscriptions).
- The second draw is made on fuel coupons, and is applicable to all accounts except those that won a free subscription.
  - The draw will be for 10 coupons every month from October to December (with a total of 30 coupons – with a value of 50 NIS per coupon). Fuel coupons can be used at any of the gas stations of the company: Al Eirsal Fuel Company.
- The third draw will be made for the monthly grand prize, and all accounts will be included in the draw except those that won a free subscription or a fuel coupon.
  - The draw will be made for a Gold Lira in October and in November, and for a smartphone in December (with a total of 3 grand prizes).
The Company has the right to suspend and/or cancel the Campaign at any time it deems appropriate, without any compensation to any of the accounts, whether subscribers or others.
Turqat reserves the right to refuse subscription and/or membership to any vehicle at its sole discretion.
